Algona Man Charged with Assaulting Law Enforcement

–An Algona man is facing charges of assaulting a peace officer following an alleged incident late last week.

According to the Algona Police Department, Officers arrested 48-year-old Donald Phipps following an incident outside a residence on E. North Street just after 6 PM on Thursday, January 15th.

A criminal complaint filed in Kossuth County District Court states that officers responded to the report of a break-in and found Phipps outside the residence. Phipps told officers that he lived there, and he was getting his wife’s car because his had broken down. When officers spoke with the reporting party inside the residence, they stated that Phipps was drunk and they did not want him in the home at that time.

Officers allowed Phipps to enter the residence in an attempt to speak with the reporting party, but an argument could soon be heard by officers outside. Phipps was again asked to leave, initially agreeing to do so before becoming uncooperative with law enforcement.

Phipps continued to be loud and argumentative, and eventually was placed under arrest. As officers attempted to place Phipps inside a patrol vehicle, he resisted, and allegedly head-butted members of the Algona Police Department and the Kossuth County Sheriff’s Office. Phipps continued to resist as he had to be forcibly removed from the patrol before being booked into the Kossuth County Jail.

Phipps is being charged with 2 counts of Assault on a Peace Officer, an Aggravated Misdemeanor, along with Public Intoxication, Disorderly Conduct and Interference with Official Acts, all Simple Misdemeanors. He is scheduled to have a preliminary hearing in Kossuth County District Court on February 5th.
