–A court ruling on pipeline related ordinances in 2 Iowa counties this week was handed down a day after the Kossuth County Board of Supervisors passed the 2nd reading of an ordinance regulating hazardous liquid pipelines. A federal judge ruled against the ordinances from Shelby and Story counties on Wednesday, saying setback restrictions would have imposed severe limitations on Summit Carbon Solutions ability to construct a pipeline if their project is given the go-ahead from the Iowa Utilities Board. Supervisor Carter Nath represents the area Kossuth County where Summit is seeking to place their Carbon Capture Pipeline, and he spoke with KLGA News about the court ruling.
The language used in Kossuth County’s pipeline ordinance was primarily based on Shelby County’s ordinance, and Nath says the impact of the court ruling is still undetermined.
