Burt Man Charged After Nearly Hitting Law Enforcement with his Vehicle

–A Burt man is facing multiple charges after he nearly hit Kossuth County Sheriff Roger Fisher and another Deputy as they were assisting a motorist along HWY 169.

According to the Kossuth County Sheriff’s Office, 50-year-old Matthew Alan Schubert was northbound on HWY 169 in the rural Algona area around 3:15 PM on Monday, December 8th. As Schubert continued north on the highway, he failed to slow down and did not move over while going past the Sheriff and Deputy.

A criminal complaint filed in Kossuth County District Court states that a traffic stop was conducted after Schubert nearly struck Sheriff Fisher with his vehicle. During the stop, the Deputy reported smelling alcohol inside the vehicle, and a breathalyzer test was conducted on Schubert, which registered above the legal limit.

Schubert was arrested on charges of OWI 2nd offense, an aggravated misdemeanor, along with Failure to Yield to an Emergency Vehicle, Failure to Reduce Speed Upon Approach of a Stationary Emergency Vehicle, Failure to Change Lanes Upon Approach of a Stationary Emergency Vehicle, and Failure to Provide Proof of Insurance.

He was booked into the Kossuth County Jail to await an initial court appearance and is scheduled to have a preliminary hearing on December 19th.
