–A Burt couple was taken into custody Sunday morning after law enforcement officials responded to the report of a domestic disturbance.
According to the Kossuth County Sheriff, neighbors reported the disturbance just before 10:30 AM Sunday. A criminal complaint filed in Kossuth County District Court alleges the couple was involved in a shoving match, which prompted the call for assistance.
The complaint goes on to say that Deputies noticed blood on 45-year-old Gerald Louis Pesicka when they arrived. Pesicka told Deputies he had pushed 29-year-old Diamond Lynn James during their altercation.
James told Deputies that Pesicka had thrown broken glass at her, pushed her, and whipped an extension cord, striking her in the neck.
After a brief investigation, Pesicka was arrested on charges of Domestic Abuse Assault Causing Injury or Mental Illness, a Serious Misdemeanor. He was booked into the Kossuth County Jail to await an initial court appearance. Online court records show he will have a preliminary court hearing on May 14th.
During the course of their investigation, Deputies learned of an arrest warrant for James out of Clay County and took her into custody as well.
